AMERICOM NETWORKS INTERNET SERVICE TERMS AND CONDITIONS
- Agreement Overview:
This Agreement is made between Americom Networks (“Provider”) and the Customer (“Customer”) for the provision of internet connectivity services as specified in the selected “Service Plan,” which is incorporated by reference. Terms like “Commencement Date,” “Monthly Rate,” and “Service Plans” refer to the definitions provided in the Service Plan. The Customer agrees to grant Provider access to install and maintain the necessary services and equipment.
- General Customer Responsibilities:
2.1 The Customer must provide accurate and up-to-date information (name, address, contact details, and payment information) when subscribing to Americom Networks’ internet services. Any changes to the Customer’s equipment used to connect to the service must be approved by Americom Networks before implementation. Failure to provide accurate information or unauthorized modifications to the equipment may result in service termination.
2.2 The internet service provided is exclusive to the Customer’s registered address. Reselling, sharing, or transmitting the service to other locations or users outside the registered premises is strictly prohibited. Unauthorized use of the service may result in immediate termination without notice.
- Service and Performance Disclaimer:
Americom Networks provides services on an “AS IS” and “AS AVAILABLE” basis, with no warranties, including but not limited to, warranties of title, non-infringement, or implied warranties of merchantability or fitness for a specific purpose. Americom Networks does not guarantee uninterrupted or error-free service and is not liable for any direct, indirect, or consequential damages resulting from the use of its services, including but not limited to data loss, delays, or system failures.
- Content Liability:
Americom Networks does not control or monitor the content transmitted over its network. The Customer assumes all risks associated with the use of the internet, including exposure to potentially offensive or harmful content. Americom Networks reserves the right to remove or restrict content deemed inappropriate or in violation of this Agreement.
- Lawful Use:
All usage of Americom Networks’ services must comply with federal, state, and local laws. Unauthorized activities, including but not limited to, sending unsolicited communications, illegal data sharing, or any activities that disrupt the Provider’s network, are prohibited. Americom Networks reserves the right to monitor usage and disclose information if required by law or to protect its network.
- Notices:
All communications related to this Agreement must be in writing and may be sent via personal delivery, email, certified mail, or other recognized methods to the address on file with Americom Networks.
- Payment Terms:
All services are billed on an auto-pay basis. Payments are due within 15 days of the invoice date. A $40 fee will be charged for any returned ACH transactions or checks that fail to clear. Late payments may result in service suspension, subject to a $25 reconnection fee. Customers are responsible for all fees related to failed payments.
- Service Plans and Changes:
Americom Networks offers multiple service plans. The Customer may be billed based on actual usage exceeding the selected plan. Services are billed month-to-month, with changes reflected in the following billing cycle.
- Equipment:
Equipment provided by Americom Networks remains its property. The Customer must take reasonable care of the equipment and return it in good condition upon termination of the service. Charges may apply for unreturned or damaged equipment.
- Customer Use:
10.1 The service is for the Customer’s personal or business use at the registered address only. Reselling or redistributing the service, using it to host websites, or operating as an Internet Service Provider (ISP) is prohibited.
10.2 Customers allowing minors to access the internet service must supervise usage to prevent access to inappropriate content. Americom Networks is not responsible for content accessed by minors.
10.3 IP addresses provided by Americom Networks are non-transferable and remain its property. Unauthorized tampering with IP addresses is prohibited.
10.4 Activities that inhibit other users’ ability to access services, disrupt the network, or engage in illegal activities are grounds for immediate service termination.
- Termination:
Americom Networks may terminate this Agreement for violations of any terms herein. Customers may also terminate services by providing 30 days’ written notice and returning all equipment. Service fees may be prorated based on the termination date.
- Governing Law:
This Agreement is governed by the laws of the State of Nebraska. All obligations and payments are due in Omaha, Nebraska. The venue for any disputes shall be in Omaha, Nebraska.
- Force Majeure:
Neither party is liable for delays or failures caused by events beyond their control, such as natural disasters, strikes, or acts of government. Payment obligations are not excused under force majeure conditions.
- Entire Agreement:
This document, along with the selected Service Plan, constitutes the entire agreement between Americom Networks and the Customer. Modifications must be in writing and signed by authorized representatives of both parties.
